This report summarises the findings of two research papers commissioned by Cordoba Peace Institute – Geneva (CPI) and written by two Iraqi Islamic scholars on the issue of the right to know the fate of missing persons from the perspective of both Islamic Law and International Humanitarian Law (IHL). It first sets out the general context in which these papers were commissioned and discussed. It then provides a summary of the two papers, the arguments they present, and the perspectives they elucidate from both Islamic Law and IHL. Finally, it describes the general mitigations and recommendations proposed by the authors as well as a concise analysis of the socio-economic implications for women and children of missing men in Iraq.
