{"id":6537,"date":"2024-06-19T21:26:22","date_gmt":"2024-06-19T20:26:22","guid":{"rendered":"https:\/\/cpi-geneva.org\/fr\/?p=6537"},"modified":"2024-06-25T00:23:38","modified_gmt":"2024-06-24T23:23:38","slug":"les-echanges-de-jurisprudence-islamique-comme-soutien-au-processus-de-mediation","status":"publish","type":"post","link":"https:\/\/cpi-geneva.org\/fr\/les-echanges-de-jurisprudence-islamique-comme-soutien-au-processus-de-mediation\/","title":{"rendered":"Les \u00e9changes de jurisprudence islamique comme soutien au processus de m\u00e9diation"},"content":{"rendered":"\n<p><\/p>\n\n\n\n<p>Lakhdar Ghettas <a href=\"https:\/\/cpi-geneva.org\/islamic-jurisprudence-exchanges-as-process-support-for-mediated-solutions\/\">English<\/a> | <a href=\"https:\/\/cpi-geneva.org\/ar\/\u0627\u0644\u062a\u0628\u0627\u062f\u0644\u0627\u062a-\u0627\u0644\u0641\u0642\u0647\u064a\u0629-\u0627\u0644\u0625\u0633\u0644\u0627\u0645\u064a\u0629-\u0643\u062f\u0639\u0645-\u0644\u0644\u062d\/\">\u0639\u0631\u0628\u064a<\/a><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Selon le CICR, sur les 450 groupes arm\u00e9s identifi\u00e9s comme posant un probl\u00e8me humanitaire en 2023, 294 op\u00e8rent dans des conflits en Afrique et au Moyen-Orient<sup data-fn=\"96d748f8-af45-44a7-b945-59715a22d72d\" class=\"fn\"><a href=\"#96d748f8-af45-44a7-b945-59715a22d72d\" id=\"96d748f8-af45-44a7-b945-59715a22d72d-link\">1<\/a><\/sup>.&nbsp;Une note d&rsquo;information du CICR indique que \u00ab&nbsp;la plupart des groupes arm\u00e9s sont pr\u00eats \u00e0 s&rsquo;engager [&#8230;] mais les \u00c9tats constituent l&rsquo;obstacle le plus fr\u00e9quent \u00e0 cet engagement [ce qui] va \u00e0 l&rsquo;encontre des raisons fr\u00e9quemment invoqu\u00e9es par les donateurs, les \u00c9tats ou d&rsquo;autres organisations humanitaires pour expliquer pourquoi ils ne financent pas, ne facilitent pas ou ne tentent m\u00eame pas de s&rsquo;engager aupr\u00e8s des groupes arm\u00e9s.&nbsp;\u00bb<sup data-fn=\"72aa411f-b938-4b29-a85f-61759b53464f\" class=\"fn\"><a href=\"#72aa411f-b938-4b29-a85f-61759b53464f\" id=\"72aa411f-b938-4b29-a85f-61759b53464f-link\">2<\/a><\/sup>&nbsp;Plus de la moiti\u00e9 des conflits arm\u00e9s impliquent aujourd&rsquo;hui des groupes arm\u00e9s qui expriment leurs int\u00e9r\u00eats et leurs revendications en termes explicitement islamiques<sup data-fn=\"47849679-d4d2-4ce7-bf2b-f91ccdd4054f\" class=\"fn\"><a href=\"#47849679-d4d2-4ce7-bf2b-f91ccdd4054f\" id=\"47849679-d4d2-4ce7-bf2b-f91ccdd4054f-link\">3<\/a><\/sup>.&nbsp;[Un nombre important de ces conflits implique des groupes arm\u00e9s djihadistes qui revendiquent une l\u00e9gitimit\u00e9 religieuse bas\u00e9e sur des r\u00e9f\u00e9rences islamiques, telles que d\u00e9finies par les \u00e9rudits religieux de chaque groupe.<\/p>\n\n\n\n<p>Les \u00e9v\u00e9nements politiques majeurs de 2022 et 2023 ont plong\u00e9 la r\u00e9gion du Sahel dans une situation humanitaire sans pr\u00e9c\u00e9dent. Selon l&rsquo;aper\u00e7u humanitaire d&rsquo;OCHA de mars 2024, 35,2 millions de personnes vuln\u00e9rables dans la r\u00e9gion, y compris des femmes, des enfants et des hommes, ont besoin d&rsquo;une assistance humanitaire au Mali, au Burkina Faso et au Niger. En outre, la r\u00e9gion abrite 5,6 millions de personnes d\u00e9plac\u00e9es et 1,7 million de r\u00e9fugi\u00e9s<sup data-fn=\"4fe313ad-dfcb-4e30-9593-17f578e1435b\" class=\"fn\"><a href=\"#4fe313ad-dfcb-4e30-9593-17f578e1435b\" id=\"4fe313ad-dfcb-4e30-9593-17f578e1435b-link\">4<\/a><\/sup>.&nbsp;Cela signifie qu&rsquo;une personne sur cinq dans le Sahel central a besoin d&rsquo;aide<sup data-fn=\"e029dfa9-60d9-4bf5-9911-f4c598538493\" class=\"fn\"><a href=\"#e029dfa9-60d9-4bf5-9911-f4c598538493\" id=\"e029dfa9-60d9-4bf5-9911-f4c598538493-link\">5<\/a><\/sup>.&nbsp;Dans l&rsquo;ensemble du Sahel central, les d\u00e9c\u00e8s dus \u00e0 la violence politique ont augment\u00e9 de 38% et les d\u00e9c\u00e8s de civils de plus de 18%<sup data-fn=\"9f6501b1-d00d-423b-a993-abfa97926dff\" class=\"fn\"><a href=\"#9f6501b1-d00d-423b-a993-abfa97926dff\" id=\"9f6501b1-d00d-423b-a993-abfa97926dff-link\">6<\/a><\/sup>.&nbsp;Avec l&rsquo;escalade de la violence dans de nombreux conflits, en particulier dans les r\u00e9gions d&rsquo;Afrique de l&rsquo;Ouest, des appels ont \u00e9t\u00e9 lanc\u00e9s par les communaut\u00e9s et des tentatives ont \u00e9t\u00e9 faites par les gouvernements, par exemple \u00e0 Djibo, au Burkina Faso, pour explorer des solutions de m\u00e9diation visant \u00e0 r\u00e9duire les difficult\u00e9s et les contraintes auxquelles sont confront\u00e9es les communaut\u00e9s civiles dans les territoires enti\u00e8rement ou partiellement sous le contr\u00f4le des groupes arm\u00e9s<sup data-fn=\"688aca5a-2f4f-40b9-9f5e-4da214f531a3\" class=\"fn\"><a href=\"#688aca5a-2f4f-40b9-9f5e-4da214f531a3\" id=\"688aca5a-2f4f-40b9-9f5e-4da214f531a3-link\">7<\/a><\/sup>.&nbsp;<\/p>\n\n\n\n<p>Compte tenu des r\u00e9sultats limit\u00e9s des campagnes militaires en termes de r\u00e9solution des conflits, des voix au sein des communaut\u00e9s touch\u00e9es par la violence, ainsi que d&rsquo;anciens responsables, ont appel\u00e9 \u00e0 un changement de cap et \u00e0 la prise en compte de dialogues qui pourraient conduire \u00e0 la lev\u00e9e des si\u00e8ges ou \u00e0 \u00e9pargner des civils non combattants dans les conflits en cours<sup data-fn=\"13c969d1-1558-46ff-9901-8f58dc183e42\" class=\"fn\"><a href=\"#13c969d1-1558-46ff-9901-8f58dc183e42\" id=\"13c969d1-1558-46ff-9901-8f58dc183e42-link\">8<\/a><\/sup>.<\/p>\n\n\n\n<p>S&rsquo;exprimant \u00e0 l&rsquo;Universit\u00e9 de Gen\u00e8ve le mois dernier, Smail Chergui, ancien commissaire de l&rsquo;Union africaine pour la paix et la s\u00e9curit\u00e9, a constat\u00e9 l&rsquo;\u00e9chec des approches pr\u00e9c\u00e9dentes visant \u00e0 stabiliser la r\u00e9gion. Malgr\u00e9 les nombreux efforts internationaux et locaux, ces strat\u00e9gies ont manqu\u00e9 de coordination et de coh\u00e9rence, ce qui a conduit \u00e0 des r\u00e9sultats quasi nuls. En r\u00e9ponse, M. Chergui propose une approche globale qui garantisse la s\u00e9curit\u00e9 humaine et la dignit\u00e9 des populations. Il insiste notamment sur la n\u00e9cessit\u00e9 d&rsquo;impliquer les dirigeants et les autorit\u00e9s locales dans l&rsquo;\u00e9laboration et la mise en \u0153uvre des politiques, car leur connaissance des r\u00e9alit\u00e9s locales est cruciale pour une stabilisation efficace<sup data-fn=\"a8ba4fc6-d449-40d4-9bba-6eccc14d5e5a\" class=\"fn\"><a href=\"#a8ba4fc6-d449-40d4-9bba-6eccc14d5e5a\" id=\"a8ba4fc6-d449-40d4-9bba-6eccc14d5e5a-link\">9<\/a><\/sup>.<\/p>\n\n\n\n<p>Les acteurs de la paix ont travaill\u00e9 avec les leaders communautaires et religieux de Track II pour sortir de l&rsquo;impasse et explorer des solutions locales, bas\u00e9es sur la m\u00e9diation, aux si\u00e8ges, aux fermetures d&rsquo;\u00e9coles et \u00e0 l&rsquo;acc\u00e8s de l&rsquo;aide humanitaire. Bon nombre de ces efforts d&rsquo;engagement ont donn\u00e9 des r\u00e9sultats tangibles en termes de lev\u00e9e des si\u00e8ges, d&rsquo;acheminement de l&rsquo;aide humanitaire ou de r\u00e9ouverture des \u00e9coles au Sahel. Cet engagement avec les \u00e9rudits religieux des groupes arm\u00e9s ayant une r\u00e9f\u00e9rence et une vision du monde islamiques prend la forme d&rsquo;\u00e9changes sur les fondements de la jurisprudence islamique (fiqh). Ils explorent les diverses options offertes par la jurisprudence islamique pour am\u00e9liorer la situation dans diff\u00e9rents contextes de conflit, sur des questions telles que les r\u00e8gles de conduite des hostilit\u00e9s, la gouvernance locale et, en fin de compte, les conditions pour des n\u00e9gociations et des solutions durables par la m\u00e9diation. Il s&rsquo;agit d&rsquo;une sorte de soutien au processus de m\u00e9diation, similaire \u00e0 celui entrepris lorsqu&rsquo;il s&rsquo;agit d&rsquo;engager les dirigeants politiques ou militaires de groupes arm\u00e9s avec une vision du monde s\u00e9culi\u00e8re. Dans ces \u00e9changes fiqhis, l&rsquo;engagement et l&rsquo;\u00e9change ont lieu entre sp\u00e9cialistes du fiqh.<\/p>\n\n\n\n<p>Ce processus soutient les efforts de m\u00e9diation et de consolidation de la paix en sensibilisant les groupes arm\u00e9s aux diverses options d\u00e9coulant de la jurisprudence islamique pour leurs politiques et leurs actions. Les exemples incluent la responsabilit\u00e9 du bien-\u00eatre des populations sous le contr\u00f4le des insurg\u00e9s (approvisionnement en nourriture, \u00e9ducation, services de sant\u00e9), le droit islamique de la guerre, les attitudes envers les minorit\u00e9s ethniques ou religieuses, et les le\u00e7ons tir\u00e9es de la tradition islamique (<em>Sulh al Hudhaybia<\/em>) pour les termes des cessez-le-feu, des tr\u00eaves et des accords de paix. La multiplication des options r\u00e9sultant de ces \u00e9changes accro\u00eet la flexibilit\u00e9 des n\u00e9gociations et emp\u00eache le durcissement des positions. La multiplication des options et la prise de conscience des diff\u00e9rences entre les contextes de conflit cr\u00e9ent plus d&rsquo;espace pour des solutions durables.<\/p>\n\n\n\n<p>Faciliter les conversations fiqhies entre des \u00e9rudits musulmans cr\u00e9dibles et influents et des \u00e9rudits membres (ou proches) des organes consultatifs (<em>Shura<\/em>) et juridiques (<em>Sharia<\/em>) des groupes arm\u00e9s d&rsquo;inspiration religieuse, sur des questions pratiques li\u00e9es \u00e0 la gouvernance par exemple, permettra un v\u00e9ritable processus de r\u00e9interpr\u00e9tation et de changement dans les attitudes et le comportement de ces groupes vers le non-extr\u00e9misme et la non-violence, vers une gouvernance respectueuse de l&rsquo;ensemble de la population qui est sous leur contr\u00f4le, et vers une volont\u00e9 de dialogue chaque fois que cela est possible.<\/p>\n\n\n\n<p>Le travail de facilitation agit sur la dimension du contexte, en aidant \u00e0 le comprendre et \u00e0 le lire. En fait, dans le travail de soutien au processus de m\u00e9diation, les m\u00e9diateurs aident souvent les parties \u00e0 mieux comprendre le contexte (international, local) afin qu&rsquo;elles puissent prendre des d\u00e9cisions plus \u00e9clair\u00e9es. La facilitation aide \u00e9galement \u00e0 l&rsquo;interpr\u00e9tation en fournissant des ressources pour des options d&rsquo;interpr\u00e9tation suppl\u00e9mentaires, telles que des exp\u00e9riences d&rsquo;ailleurs et une perspective historique. Elle peut \u00e9galement sugg\u00e9rer des options d&rsquo;action dans une situation donn\u00e9e, afin de guider ou d&rsquo;orienter l&rsquo;action d&rsquo;une mani\u00e8re compatible avec le fiqh, la <em>wasatiya<\/em> et le dialogue.<\/p>\n\n\n\n<p>Les groupes arm\u00e9s d&rsquo;inspiration religieuse agissent en fonction d&rsquo;une r\u00e9f\u00e9rence (syst\u00e8me de valeurs) qui d\u00e9termine leur attitude et leur comportement \u00e0 l&rsquo;\u00e9gard des autres. Ils agissent \u00e9galement dans un contexte sp\u00e9cifique, et l&rsquo;imbrication de la r\u00e9f\u00e9rence et du contexte d\u00e9clenche un processus d&rsquo;interpr\u00e9tation sur la mani\u00e8re dont la r\u00e9f\u00e9rence peut \u00eatre utilis\u00e9e concr\u00e8tement pour atteindre l&rsquo;objectif souhait\u00e9<sup data-fn=\"009a4b7e-0c87-4a77-8794-591c4e96c58a\" class=\"fn\"><a href=\"#009a4b7e-0c87-4a77-8794-591c4e96c58a\" id=\"009a4b7e-0c87-4a77-8794-591c4e96c58a-link\">10<\/a><\/sup>.&nbsp;Le processus d&rsquo;interpr\u00e9tation (une relecture du syst\u00e8me de valeurs qui ne change pas lui-m\u00eame) est appel\u00e9 ijtihad dans la tradition islamique. Il produit un cadre juridique qui conditionne les pratiques et les actions des groupes arm\u00e9s d&rsquo;inspiration religieuse. L&rsquo;imam Ibn Qayyim al-Jawziyya (1292-1350) d\u00e9finit d&rsquo;ailleurs l&rsquo;origine, la voie et le but<sup data-fn=\"977445be-8470-4e80-a3fe-c960d1513105\" class=\"fn\"><a href=\"#977445be-8470-4e80-a3fe-c960d1513105\" id=\"977445be-8470-4e80-a3fe-c960d1513105-link\">11<\/a><\/sup>. Il est \u00e9vident qu&rsquo;\u00e0 partir d&rsquo;une m\u00eame origine (r\u00e9f\u00e9rence), il existe diff\u00e9rents chemins (possibilit\u00e9s d&rsquo;interpr\u00e9tation) pour atteindre le m\u00eame but recherch\u00e9. Le chemin, sujet \u00e0 interpr\u00e9tation, doit servir le but et \u00eatre en accord avec la r\u00e9f\u00e9rence. Si le moyen est l&rsquo;action arm\u00e9e, il doit \u00eatre conforme au droit religieux de la guerre (qui pr\u00e9sente de nombreux points communs avec le droit international humanitaire). La conformit\u00e9 \u00e0 la norme de r\u00e9f\u00e9rence est appel\u00e9e <em>wasatiya<\/em>, le contraire de <em>ghuluw<\/em> (extr\u00e9misme)<sup data-fn=\"43373281-8236-4b18-a598-b5596126aa4e\" class=\"fn\"><a href=\"#43373281-8236-4b18-a598-b5596126aa4e\" id=\"43373281-8236-4b18-a598-b5596126aa4e-link\">12<\/a><\/sup>.&nbsp;[12]<\/p>\n\n\n\n<p>Le processus d&rsquo;interpr\u00e9tation\/<em>ijtihad<\/em> n&rsquo;est pas ouvert \u00e0 tous ; il requiert l\u00e9gitimit\u00e9 et expertise. C&rsquo;est le r\u00f4le et le devoir des \u00e9rudits islamiques reconnus et cr\u00e9dibles. La (r\u00e9)interpr\u00e9tation peut \u00eatre le r\u00e9sultat de v\u00e9ritables d\u00e9lib\u00e9rations internes entre \u00e9rudits au sein ou \u00e0 proximit\u00e9 de groupes militants. Elle peut \u00e9galement \u00eatre assist\u00e9e par une tierce partie, qui doit bien conna\u00eetre la r\u00e9f\u00e9rence et le contexte, et \u00eatre per\u00e7ue par les acteurs comme honn\u00eate, juste et impartiale.<\/p>\n\n\n\n<p>CPI a entrepris de tels efforts avec ses partenaires locaux pour explorer les Voies Fiqhies. Cet effort de soutien au processus permet de sensibiliser les d\u00e9cideurs politiques internationaux aux dialogues et aux initiatives de r\u00e9solution de probl\u00e8mes fond\u00e9s sur la jurisprudence islamique qui sont d\u00e9j\u00e0 en cours. Enracin\u00e9s dans une vision du monde diff\u00e9rente, les d\u00e9cideurs politiques \u2013 ou certaines parties au conflit confront\u00e9es \u00e0 des insurrections islamistes \u2013 ont parfois du mal \u00e0 comprendre la \u00ab&nbsp;langue&nbsp;\u00bb parl\u00e9e par les insurg\u00e9s et ce en quoi ils croient fermement.
