Two factors have come to the fore of Moroccan public debate in the past fortnight, including women&rsquo;s and labour rights, both of which affect large numbers of the population.<\/p>\n<p>Issues affecting Moroccan women have increasingly become a heated source of debate, and of friction between actors with religious- and secular-based identities. Recently, a prominent women&rsquo;s rights activist, Fouzia Assouli, called for gender equality in Moroccan inheritance law. Women&rsquo;s rights in the country have witnessed recent developments &#8211; including the 2004 royal establishment of a revised Moudawana family code, which aimed to reconcile Islamist and secular aspirations for national legislation. The revision was widely approved in Morocco, however figures like Assouli have consistently pointed out that significant parts of the old legal system remained unreformed. \u00ab\u00a0Current inheritance law in Morocco states that men receive double the inheritance of their female relatives,\u00a0\u00bb according to The New Arab; a system that is extrapolated from Islamic law, and in particular from the Maliki school. Assouli told the newspaper that \u00ab\u00a0[she is] fighting desperately to change mentalities to accept the idea that women are the other half of men,\u00a0\u00bb because she believes that \u00ab\u00a0the current inheritance laws lead to prejudice against the rights of women and strip them of their financial independence.\u00a0\u00bb Conservative religious scholars and government officials have reacted to Assouli&rsquo;s demands as an affront to the Moroccan constitution and Shariah, the source of the inheritance law, but it was reported that Assouli does not see a contradiction; stating: \u00ab\u00a0religion is not in conflict with social justice.\u00a0\u00bb This exchange demonstrates how the debate over issues concerning Moroccan women is most often expressed as the opposition of religious and secular legal systems, which undermines the potential for serious public discussion of important issues like women&rsquo;s and children&rsquo;s health, education, security and psychological wellbeing, all of which have serious consequences for the future of a country with huge aspirations.<\/p>\n<p>Outside of tension over the different aspirations for Moroccan legislation, the country is also witnessing greater disaffection with the socio-economic policies of the PJD government. The most determined demonstrations of this have been continuing nationwide protests by teacher trainees. These were triggered by two controversial government decrees that undermined the job security and threatened to worsen the unemployment crisis of Moroccan teachers. The government has recently come under local and international criticism for 7 January&rsquo;s \u00ab\u00a0black Thursday\u00a0\u00bb, when Moroccan security forces were documented violently dispersing peaceful protestors. The Interior Minister, Mohammad Hassad, alleged that the security intervention was ordered by Benkirane, who denied any knowledge of the events. The Interior Minister emphasised that the protests were \u00ab\u00a0unauthorised\u00a0\u00bb and \u00ab\u00a0posed a danger to citizens\u00a0\u00bb &#8211; under Moroccan law, organisers of demonstrations on public streets are required to receive the approval of local authorities. However according to The New Arab, \u00ab\u00a0organisers of the nationwide movement told Human Rights Watch they did not formally notify the authorities&#8230; as they were certain the government would not grant approval.\u00a0\u00bb<\/p>\n<p>Observers have noted that these ongoing protests \u2013 now months long \u2013 will necessarily affect the popular base of support that has carried the PJD to power and maintained it in its strong position. The wide distribution of images of police violence against young protestors on social media will lead to disenchantment with the party&rsquo;s promises of social justice, which it expresses in the framework of its religious identity.<\/p>\n<p>On 20 January, and perhaps indicating the pressure he is currently under, Benkirane offered teacher trainees a deal, in order to encourage their departure from the Moroccan streets. Protestors were not satisfied with the deal, however, and thousands of demonstrators marched through Rabat on Sunday 24 January, defying a government ban. The New Arab reported that protestors chanted \u00ab\u00a0We&rsquo;re prepared to go to prison\u00a0\u00bb as they approached the parliament building in the capital. Although the Political Agreement stipulates that it should be approved by the HoR and the GNC (the Council of State), UNSMIL seems to have put aside this legal requirement and pressed on with forming the Government of National Accord within the 30-day deadline. Intense pressure on the Faiz Seraj and his Presidency Council delivered, two days beyond the deadline on 19 January, a 32-member government instead of the initially intended small cabinet of 10-22 portfolios. Those close to the intense negotiations explained how regional, tribal and even crony considerations weighed heavily on forming the government. As a result, some ministries were broken down into three to satisfy all. This was the case of the ministry of foreign affairs which was divided into another for Arab and African affairs, and a third for international cooperation. It was also the case of the justice portfolio which was broken down into one for national reconciliation and a third for human rights and refugees. Despite the fact that the Political Agreement was not approved by the HoR nor the GNC, and that the Constitutional Declaration was not amended as the Agreement stipulates, a session of the HoR was convened to proceed to a vote of confidence on Seraj&rsquo;s Accord Government, on 25 January, before the end of the ten-day deadline. Out of the 104 HoR MPs who attended the session, 97 rejected Seraj&rsquo;s government. The block that declined to offer confidence to Seraj&rsquo;s government evoked the necessity of amending the terms of reference of the Presidency Council of the Council of Ministers in Article 8.2.a which stipulate that the said council \u00ab\u00a0assume the functions of the Supreme Commander of the Libyan army who appoints and removes the Head of the army\u00a0\u00bb. It is now clear that Khalifa Hafter&rsquo;s lobbying has succeeded in blocking UNSMIL&rsquo;s process. This is a major challenge for Martin Kobler since the Political Agreement is considered final. Giving in to Hafter&rsquo;s pressure and blackmailing would put UNSMIL in a very awkward position since it has rejected Nouri Bousahmin&rsquo;s calls to amend the draft political agreement, under Bernardino Leon, and then under Kobler, for the GNC to sign it. It is unclear how UNSMIL would respond to this new deadlock. Hafter&rsquo;s camp is not that strong though. Last week&rsquo;s resignation of Major Mohamed Hijazi, spokesman of Hafter&rsquo;s Dignity Operation has shaken Hafter&rsquo;s base and betrayed a shift in the tribal alliances underlying it. Some HoR MPs who signed the Political Agreement now say that the HoR confidence vote session was illegal since the Political Agreement was not yet approved by the HoR and the Constitutional Declaration was amended. Would UNSMIL press on and continue to disregard these legal considerations stipulated by the Agreement? It has just three days before the end of the ten-deadline. In a scenario reminiscent of Bouazizi&rsquo;s self-immolation in December 2010, which sparked the 2011 uprisings across the Arab world, the suicide of jobless electrical engineering graduate Ridha Yahyaoui transformed peaceful sit-ins of unemployed graduates into a wave of protests that threatened to engulf all of Tunisia. The government moved hastily and imposed a nationwide curfew in an attempt to quell the protests. There have been mixed reactions from the government and the political elite. While all recognise that underdevelopment of the said regions is a reality that should be addressed, the government and some political parties seized the opportunity to strike points against their political adversaries. The leftist opposition coalition Popular Front was accused during a popular talk show of being behind the protests, while Ennahda almost explicitly accused the Tahrir Party of fuelling the protests. Beyond the political blame game, the Kasserine protests show that the profound changes set off by the 2011 uprisings are still at work. The protests&rsquo; geographic spread could be juxtapositioned on Tunisia&rsquo;s poverty, underdevelopment and marginalisation map since independence (1984-85 bread protests, 2007-08 phosphate mines protest, 2010-11 Sidi Bouzid 2016 Kasserine protests). The protesting regions voted for Ennahda in the legislative elections and for Moncef Merzouki in the presidential elections in the winter of 2014. This is a classic of Tunisian affairs; the development and political elite reservoir fault-line between Tunisia&rsquo;s northeast and coastline towns versus the marginalised periphery on the Algerian and Libyan borders. One would say it is the deep society striking back (again) against the deep state. There is however a novelty this time; Ennahda, whose popular base is anchored the deep society map, is increasingly losing support within disenchanted youth who do not feel represented by Ennahda&rsquo;s consensus policy. Ennahda will always retain its 20% share in Tunisian society and politics but it is increasingly losing support among youth and other segments of society who five years on disapprove of the social contract that came out of the 2014 National Dialogue. The Popular Front, Tahrir Party, Merzouki&rsquo;s new Tunisia&rsquo;s Willingness all see a political opportunity to fill the vacuum left by the disarray of Nidaa Tunis and retreat of Ennahda. One thing is sure: the forces unleashed in 2011 in Sidi Bouzid are profound and run deep across the whole region. Ces anciens d\u00e9tenus (El Khattab a \u00e9t\u00e9 lib\u00e9r\u00e9 r\u00e9cemment, en novembre 2015) ont re\u00e7u une gr\u00e2ce royale \u00ab quand ils ont officiellement d\u00e9clar\u00e9 leur fid\u00e9lit\u00e9 aux principes de la nation, ses lieux saints, et les institutions nationales, et apr\u00e8s que nous avons examin\u00e9 leurs positions id\u00e9ologiques et leurs tendances et qu&rsquo;ils ont renonc\u00e9 \u00e0 l&rsquo;extr\u00e9misme et le terrorisme \u00bb, a indiqu\u00e9 le Minist\u00e8re de la justice. Apr\u00e8s quoi, ils ont donc re\u00e7u l&rsquo;autorisation officielle de se livrer \u00e0 un travail politique au sein des organisations existantes.<\/p>\n<p>Dans son annonce, Fizazi a d\u00e9crit la mission de l&rsquo;association en trois points particuliers : \u00ab lutter contre la criminalit\u00e9 et le harc\u00e8lement, faire la promotion des valeurs de l&rsquo;islam et surtout lutter contre l&rsquo;extr\u00e9misme islamiste. \u00bb Il a confirm\u00e9 que son groupe mobilisait actuellement \u00ab des jeunes salafistes d\u00e9sengag\u00e9s \u00bb \u00e0 la cause de l&rsquo;association. N\u00e9anmoins, a-t-il insist\u00e9, l&rsquo;association n&rsquo;a pas d&rsquo;identit\u00e9 salafie. Cette annonce est le dernier d\u00e9veloppement dans l&rsquo;engagement salafi dans la mobilisation populaire au Maroc, ce que les observateurs consid\u00e8rent comme une approche visant \u00e0 prot\u00e9ger le royaume contre des menaces \u00e0 sa s\u00e9curit\u00e9 et \u00e0 promouvoir la stabilit\u00e9 du syst\u00e8me politique.<\/p>\n<p>En novembre 2015, El Khattab, avec un autre salafi bien connu, Abdelkrim al-Chadli, avait annonc\u00e9 la formation du \u00ab Mouvement Salafi pour la R\u00e9forme Politique \u00bb (voir Cordoba Update 03-16.11.2015), \u00e9tabli comme l&rsquo;aile religieuse d&rsquo;un parti politique existant : le Mouvement D\u00e9mocratique et Social. Avant cela, en 2013, Mohamed Abdelwahab Rafiqui (surnomm\u00e9 Abou Hafs), \u00e9galement ancien d\u00e9tenu salafi, a rejoint le Parti islamiste de la Renaissance et de la Vertu, ouvrant la voie \u00e0 une plus grande participation des salafis \u00ab r\u00e9formistes \u00bb dans la politique marocaine.<\/p>\n<p>Cheikh Fizazi est un acteur salafi bien connu au Maroc, remarquable pour ses liens \u00e9troits avec la famille royale &#8211; il est surnomm\u00e9 \u00ab le salafiste de Sa Majest\u00e9 \u00bb. Sa pr\u00e9sence croissante dans les courants politiques marocains a conduit \u00e0 certaines critiques, en particulier sur les r\u00e9seaux sociaux, o\u00f9 certains accusent Fizazi d&rsquo;argumenter en d\u00e9fense du terrorisme un jour et de coop\u00e9rer avec les services de s\u00e9curit\u00e9 du royaume le lendemain.<\/p>\n<p>Dans une interview du 25 janvier, Rafiqui a soulign\u00e9 les tendances salafistes diff\u00e9rentes qui existent dans le monde musulman, en d\u00e9crivant ce qu&rsquo;il appelle dans le contexte marocain \u00ab le salafisme nationaliste \u00bb. \u00ab Il s&rsquo;agit d&rsquo;un mouvement moralisateur et r\u00e9formateur qui a servi de base intellectuelle \u00e0 la lutte anticolonialiste au Maroc, surtout \u00e0 l&rsquo;\u00e9gard du colon fran\u00e7ais qui instaurait une domination \u00e0 la fois politique et culturelle. \u00bb Rafiqui a \u00e9galement estim\u00e9 que \u00ab le m\u00e9lange entre la pr\u00e9dication et la politique conduit \u00e0 un \u00e9chec certain. Samir Geagea, chef des Forces libanaises, a annonc\u00e9 son soutien \u00e0 la candidature \u00e0 la pr\u00e9sidence de Michel Aoun, fondateur du Courant patriotique libre. Cette annonce a pour le moins surpris, voire choqu\u00e9, au vu de l&rsquo;histoire de ces deux hommes. En effet, ces derniers sont connus pour leur rivalit\u00e9 historique qui a atteint son pic dans les ann\u00e9es 88-90, p\u00e9riode connue sous le nom de \u00ab la guerre de l&rsquo;\u00e9limination \u00bb, pendant lesquelles l&rsquo;Arm\u00e9e libanaise et les Forces libanaises se sont affront\u00e9s dans des combats violents. En 2005, apr\u00e8s le retrait syrien, M. Aoun est revenu d&rsquo;exil et S. Geagea a \u00e9t\u00e9 rel\u00e2ch\u00e9 de prison. Leur rivalit\u00e9 se concr\u00e9tise alors dans leur soutien respectif aux deux forces oppos\u00e9es, S. Geagea choisissant de s&rsquo;allier avec le 14 Mars et M. Aoun avec le 8 Mars, et Hezbollah en particulier. A la fin de la pr\u00e9sidence de Michel Suleiman, le vacuum pr\u00e9sidentiel s&rsquo;impose alors que S. Geagea annonce sa candidature soutenue par le 14 mars et rejet\u00e9e par M. Aoun et le 8 Mars.<\/p>\n<p>Pour certains observateurs, ces deux derniers d\u00e9veloppements, l&rsquo;initiative Hariri-Frangieh aussi bien que de l&rsquo;alliance Geagea-Aoun, auraient pu \u00eatre motiv\u00e9s par la volont\u00e9 de pousser le Hezbollah \u00e0 d\u00e9bloquer la situation en proc\u00e9dant \u00e0 l&rsquo;\u00e9lection d&rsquo;un pr\u00e9sident. Or il semblerait que le r\u00e9sultat soit au contraire un affaiblissement du 14 Mars, dont la coh\u00e9sion en ressort endommag\u00e9e. S. Geagea se serait engag\u00e9 dans cette alliance par d\u00e9pit de voir son alli\u00e9, le Courant du Futur, choisir un nouveau candidat sans le consulter. Quant \u00e0 Samy Gemayel, pr\u00e9sident des Kata\u00ebb, il a refus\u00e9 vendredi 22 janvier l&rsquo;un et l&rsquo;autre candidats, affirmant qu&rsquo;il ne soutiendrait pas de candidat \u00ab porteur du projet du 8 Mars \u00bb. Ces deux candidatures se seraient ainsi neutralis\u00e9es selon certains analystes.<br \/>\nDe son c\u00f4t\u00e9, le Hezbollah ne semble pas troubl\u00e9, ne se sentant pas dans le besoin de justifier son refus \u00e0 coop\u00e9rer pour l&rsquo;\u00e9lection d&rsquo;un pr\u00e9sident.<\/p>\n<p>D&rsquo;autres observateurs mettent en garde contre ce qui pourrait se produire. En effet, selon un ministre chr\u00e9tien, \u00ab plus de 85% de l&rsquo;opinion publique chr\u00e9tienne est avec Aoun, apr\u00e8s que S. Geagea et son parti lui ont assur\u00e9 leur soutien. Si le quasi-consensus chr\u00e9tien s&rsquo;av\u00e8re incapable de mener \u00e0 l&rsquo;\u00e9lection d&rsquo;un pr\u00e9sident, les choses peuvent alors tourner en d\u00e9veloppements radicaux. Ce sera alors clair que le r\u00e9gime libanais entier n&rsquo;est plus viable. \u00bb Un autre analyste observe que le soutien de S. Geagea \u00e0 M. Aoun est un coup dur pour l&rsquo;Accord de Taef. M. Samaha aurait confirm\u00e9 ces accusations, arguant qu&rsquo;il aurait \u00e9t\u00e9 victime d&rsquo;un pi\u00e8ge. En mai 2015, il avait \u00e9t\u00e9 condamn\u00e9 \u00e0 quatre ans et demi de prison pour ces crimes, verdict qui a \u00e9t\u00e9 qualifi\u00e9 de \u00ab scandaleux \u00bb par le ministre de la justice, Ashraf Rifi, comme cela impliquait une possible remise en libert\u00e9 aussit\u00f4t que fin 2015. La cour de cassation a annul\u00e9 le verdict en juin 2015 et a impos\u00e9 un nouveau jugement dont la premi\u00e8re session s&rsquo;est tenue le 21 janvier.<\/p>\n<p>L&rsquo;annonce de sa remise en libert\u00e9 sous caution, bien qu&rsquo;accus\u00e9 de complots terroristes, en d\u00e9but d&rsquo;ann\u00e9e a non seulement choqu\u00e9, mais elle a aussi remis la question des cours militaires sur le devant de la sc\u00e8ne. De nombreuses personnalit\u00e9s ont appel\u00e9 \u00e0 la dissolution du Tribunal militaire, jug\u00e9 arbitraire. En effet, selon des observateurs, les partisans du 14 Mars condamnent le biais de cette institution en faveur du 8 Mars, et en particulier l&#8217;emprise de Hezbollah sur ces cours. Bon nombre r\u00e9clament que ce Tribunal ne soit op\u00e9rant qu&rsquo;en cas de jugement de soldats, et non plus de civils. Alors que l&rsquo;on entend beaucoup d&rsquo;experts, de politiciens, de politologues, de sp\u00e9cialistes du \u00ab genre \u00bb parler dans les m\u00e9dias, on entend peu les r\u00e9fugi\u00e9s eux-m\u00eames. Un t\u00e9moignage de migrant a cependant \u00e9t\u00e9 recueilli par un journaliste de France culture sur l&rsquo;\u00eele de Lesbos, il y a quelques jours. R\u00e9fugi\u00e9 afghan et interrog\u00e9 \u00e0 son arriv\u00e9 sur l&rsquo;\u00eele, ce dernier a notamment d\u00e9clar\u00e9 que les individus ayant commis les attaques de Cologne \u00e9taient des personnes \u00ab manquant d&rsquo;\u00e9ducation \u00bb et que cela n&rsquo;\u00e9tait pas repr\u00e9sentatif de l&rsquo;ensemble des r\u00e9fugi\u00e9s. Quelques autres t\u00e9moignages de migrants syriens ont notamment \u00e9t\u00e9 recueillis dans le journal allemand Die Zeit, et des r\u00e9fugi\u00e9s ainsi que des Allemands se sont organis\u00e9s au sein de manifestations pacifiques en Allemagne afin de protester contre les discours stigmatisant de certains partis populistes envers les r\u00e9fugi\u00e9s et les musulmans.<\/p>\n<p>La piste des r\u00e9seaux criminels marocains, notamment la mafia de D\u00fcsseldorf, est une des nouvelles explications qui a vu r\u00e9cemment le jour dans la presse allemande et qui pourrait expliquer en partie les \u00e9v\u00e8nements de la nuit de la Saint Sylvestre. Ses deux complices, eux, attendent d&rsquo;\u00eatre jug\u00e9s pour complicit\u00e9 de d\u00e9lit de fuite d&rsquo;un d\u00e9tenu et du crime d&rsquo;appartenance \u00e0 une organisation terroriste. Les d\u00e9fenseurs des libert\u00e9s fondamentales soulignent que le terme \u00ab menace terroriste \u00bb est flou. Il serait donc en train de n\u00e9gocier avec le parti d&rsquo;extr\u00eame droite Jobbik afin de faciliter l&rsquo;adoption de cet amendement, ce qui inqui\u00e8te les partis d&rsquo;opposition \u00e0 droite comme \u00e0 gauche.<\/p>\n<p>L&rsquo;Europe, enfin, ne semble s&rsquo;\u00eatre pr\u00e9occup\u00e9e de ces mesures, risquant de mettre \u00e0 mal les libert\u00e9s civiques, seulement apr\u00e8s les r\u00e9centes d\u00e9cisions prises par le gouvernement polonais, \u00ab\u00a0des r\u00e9formes controvers\u00e9es, accus\u00e9es par certains de porter atteinte \u00e0 l&rsquo;exercice normal des droits d\u00e9mocratiques et \u00e0 l&rsquo;\u00e9quilibre politique du pays\u00a0\u00bb, selon le Parlement europ\u00e9en.
